The restrictions put in place under the Coronavirus Act 2020, in relation to commercial possession proceedings, have now been extended by the government, so that the stay expires on 31 December 2020.

This means that it will not be possible to progress any possession proceedings until the commencement of the New Year, and for many landlords, where rent arrears are already high, this may raise concerns.

The government has reinforced its reinsurance, that where tenants are able to pay rent, they should pay rent; but it is likely that some tenants will use this as an opportunity, to try to make back some of the money which they lost as a result of the initial lockdown, to attempt to balance the books.
