Failing to Provide a Specimen for Analysis

If you fail to provide a sample of blood, breath or urine for analysis when requested, you can be prosecuted for the offence of failing to provide a specimen without reasonable excuse. Similarly, to drink and drug driving, a conviction of this kind will result in a mandatory disqualification period of not less than 12 months.

At Paul Robinson’s, we regularly instruct experts in this field to provide evidence to the Court of reasonable excuse and have successfully defended such cases at Court. Representations have also been successfully made to the Crown Prosecution Service in advance of trial for the case to be reviewed and charges discontinued.
