What is a caveat?
A caveat is a written notice given by someone (the caveator) to show that a grant should not be issued in a deceased person’s estate without the caveator being notified.
A person may enter a caveat where they:
• Doubt the validity of a deceased’s will.
• Believe that there may be a valid will so that the deceased did not die intestate.
• Object to a grant issuing to a particular person (for example, because the caveator doubts their ability to administer the estate properly).
• Wish to begin a probate claim.
• Wish to begin citation proceedings.
Challenge someone else’s probate application
You can challenge someone else’s probate application (‘enter a caveat’) if there’s a dispute, for example about:
- who can apply for probate
- whether a will exists
- whether the will is legal
The caveat lasts for 6 months at first, then you can extend it for another 6 months. The caveat stops all applications for probate on the estate being granted during that time.

You must be 18 or over.
You can do it yourself, or instruct one of our specialist Contentious Probate Solicitors. Fixed fees are offered for this service.
The fee to enter a caveat payable to the probate registry is £3.00.
What information you need
You need:
- the full name of the person who’s died and any other names they were known by
- the exact date of death on the death certificate
- the last address of the person who’s died
- your home address in England or Wales
