Offences committed by members of the Armed Forces, or civilians affiliated with the Armed Forces, are often dealt with by way of a Court Martial. This applies not just for disciplinary offences under Service Law, but for civilian offences as well.

Police Interview

Regardless of whether you are arrested by Service Police, or civilian police, you are entitled to FREE and independent legal representation. When your rights and entitlements are explained to you, you will be asked whether you would like legal advice. In our experience, you should always say “yes”. Court Martial

If the Service Prosecuting Authority (SPA) decide to bring charges against you, for those proceedings which are not capable of being dealt with by your Commanding Officer, a Court Martial Trial will take place.

In the UK, Court Martial trials will take place at one of the two military court centres:

  • Bulford, or
  • Catterick

The trial process itself is much the same as a civilian Crown Court trial. Proceedings will be adjudicated by a Judge Advocate, whilst the Jury, known as the Board, will determine guilt or innocence. The Board is made up of commissioned officers and warrant officers.

Just as there is Legal Aid for proceedings in civilian courts, there is funding available for Court Martial proceedings via the Armed Forces Criminal Legal Aid Authority (AFCLAA). An application for funding must be submitted, which your Assisting Officer, can help you with. Within this application you can request representation from a legal firm of your choice. The application is means tested and so, depending on your income, you could be ordered to pay a contribution towards the cost of your representation. The AFCLAA will notify you, should this be the case.
