We are specialists in exceptional hardship. By law if you accumulate 12 penalty points or more within a 3 year period you will be summonsed to appear before the Magistrates Court to face disqualification for a minimum period of 6 months. This is commonly known as “totting” up.
Many motorists find themselves in this position and are not aware that they can make an application to the Court to ask them not to disqualify them on the grounds of “exceptional hardship”. Exceptional hardship would usually involve real hardship to the motorist or other people who will be affected if the motorist is disqualified. Courts often hear these applications and always examine any request not to disqualify a motorist. It is therefore important that any application is thoroughly prepared and presented alongside any supporting evidence.
