The Party Wall Act 1996 (the ‘Act’) has one main objective; to prevent, and assist in the resolution of, neighbour disputes arising from party walls, party structures, boundary walls and excavations. The Act seeks to balance and observe the rights of each property owner by ensuring property owners can carry out building or excavation works to their respective properties on the condition that adjoining property owners are notified and given the opportunity to consent to, or dispute, the proposed works. These boundaries are often referred to as a ‘Party Wall’. The Act provides that there are two types of Party Walls; Party Wall A are walls that stand astride the boundary of land belonging to two (or more) individual owners and Party Wall B are walls that stand exclusively on one owner’s land, but is used by two (or more) owners to separate their buildings. Boundary walls and external walls are not considered to be Party Walls. There are significant consequences for not adhering to the procedure prescribed by the Act and for that reason, it is imperative that advice is sought prior to the commencement of any building works or excavations and prior to consenting to such works.
