What is the Children Act, and how does it impact families?
The Children Act deals with legal matters concerning children, and is dealt with in the Court by way of a Child Arrangement Order. It covers a wide range of issues, including a ‘Live with’ Order (previously known as Custody or residence) and ‘Spend time with’ Order ( previously known as access or contact). It can also cover other matters such as a Prohibited Steps Order, Specific Issue Orders (known as s8 Orders) and Parental Responsibility. What factors does the Court take into consideration when determining a Child Arrangement Order?
The Court will need to consider a number of matters in order to reach a decision for the child, and may need to have professionals report to them on certain issues, which may include the child’s age, emotional and educational needs, the ability of each parent to provide a stable home, and any risks to the child’s welfare. What is parental responsibility, and how is it determined?
Parental Responsibility refers to the legal rights, duties, powers, and responsibilities a parent has regarding their child. In the England and Wales, mothers automatically have Parental Responsibility, whilst fathers can acquire it under certain conditions. We can help you obtain Parental Responsibility in the event that you do not hold Parental Responsibility for your child.
What is the difference between a Live with Order and a Shared Care Order?
A live with Order decides as to where and whom the child lives, and gives that parent the right to leave the country for the purpose of a holiday for up to 28 days without the written consent of the other parent. A shared Care/ live with Order means that the child lives with both parents, although this may for different periods of time.
What steps should I take if my ex-partner violates a Child Arrangement Order?
If your ex-partner is not complying with a Child Arrangement Order, it is essential to seek legal advice promptly. Our team can guide you through the steps to enforce the Order and, if necessary, seek a variation of the Order to meet your child’s needs.
How long does the process of applying for a Child Arrangement Order typically take?
