Electric scooters (commonly known as ‘e-scooters’) have been hailed in city capitals as being a new, more environmentally friendly mode of transport. However, with the recent death of television presenter Emily Hartdridge, the legality of these scooters have been called into question.
Electric scooters are powered by a battery motor and are therefore fall under the category of Personal Light Electric Vehicles (PLEVs) by the Department for Transport.
Whilst there has been a recent rise in the use of electric scooters, many riders are not aware that riding an electric scooter on a public road is illegal under the Road Traffic Act 1988. Under the Highway Act 1835, it is also illegal to ride electric scooters on a pavement. The reason for this is that the design of electric scooters mean that it is almost impossible to comply with the UK laws regarding indicators and brake lights.
However, the electric scooter can be used on private land, and this includes your home or any off-road space.
If you are found to be in breach of the law, you can face a £300 fine and 6 points on your licence. Your scooter can be seized.
The shadow transport secretary Andy McDonald has said that there is a need for the government to provide guidance on this area of law. Britain needs to change centuries old legislation.
Unfortunately, the current position on the legality of electric scooters is largely unknown to users, particularly as many retailers of these scooters fail to inform their customers of the laws surrounding them.
